Civil Assets Recovery

Civil Asset Recovery is the process under which assets are recovered from individuals through a civil court rather than relying on criminal courts. It is a process similar to confiscation which involves tracing, freezing, confiscating, and returning the stolen assets to the country or their main origin. It involved the recovery of the assets that are acquired using unlawful means or conduct.

The idea is laid upon assets that are sought using criminal means though there is no need for criminal convictions. Depending upon the type of case and the jurisdictions involved, asset recovery is done by opting for legal tools.  The legal actions to pursue asset recovery are diverse because the process of civil asset recovery is rational and robust.

The procedure is usually a complicated and lengthy one that may involve multiple jurisdictions and laws. This makes the entire process complex and technical. There may be technical, legal, and political barriers involved in it. But this is not meant for the every Civil Case. It cannot take a long time or few month always. The main purpose of asset recovery is to make the best use of the laws to disrupt crime and reduce the harm that is caused to the community. It is the process that ensures that crime doesn’t pay by seizing or confiscating the assets of an individual.

The individual may acquire them as a result of crime including theft of cash, property, vehicle, high-value goods, and much more. Under this, there is no need for a criminal conviction or even for the criminal investigation to proceed. Criminal Cases bring punishments only. For assets and financial recovery, we need to go to Civil Courts or Commercial Courts.

This process will make it more straightforward but is further described in Laws and statutes. Under multiple cases, a criminal conviction is not needed which gives rise to its significance. The large quantity of money received by the government is a by-product of asset recovery. The intent is to reduce criminal activities and move toward asset recovery.

Civil Asset Recovery is just like confiscation where a single person is convicted of committing a crime. Furthermore, he may be suspected to have benefited financially from the crime. Legal action against the individual is taken to confiscate the assets acquired from the criminal activities.

The role of the civil asset recovery procedure is to recover the worth of the assets that have benefitted the individuals in form of cash, vehicle, properties, etc. the recovery of the value of assets can be recovered by following the confiscation process.

The whole procedure is similar except that in the case of an individual doesn’t have to be convicted of an offense for the assets to be recovered. For the process to continue it has to be proved that assets are acquired as a result of criminal activity on a balance of probability rather than doubt or possibility.

The prosecutor will commence the civil proceedings by naming the asset as the defendant and seeking to forfeit the asset independent of any criminal proceedings. The process of civil asset recovery can be confusing when applied in an international context. Additionally, it may cause unwanted distractions.
